Minimum Wage Eligibility

Generally, employees working for the types of companies and organizations below, whether for-profit or non-profit, are eligible for minimum wage under Federal law.

  • Any that gross $500,000 or more annually
  • Any engaged in interstate commerce
  • Federal, state and local government agencies
  • Hospitals and institutions engaged in the care of sick, aged or mentally-ill people
  • Educational institutions including preschools

Domestic service workers, such as day workers, housekeepers, chauffeurs, cooks and babysitters, are also entitled to minimum wage, if they

  • Receive at least $1,300 in annual cash wages from one employer or
  • Work a total of more than eight hours a week for one or more employers

But there's more to it than this, and special rules and exemptions might apply under either Federal or state minimum wage law.
